Terms and conditions for photography workshops and holidays/safaris
These terms and conditions form the basis of the contract between Chris Weston (Photography Workshops) Ltd (CWPW Ltd) and the participant.
1) Deposits and payments
For photographic holidays/safaris:
1.1 A non-refundable deposit of the amount stated in each holiday description is required at the time of booking.
1.2 The balance of the tour price is due 10 weeks prior to the departure date. Should this final payment fail to reach us or our agent by the date specified, we reserve the right to treat the booking as cancelled and retain the deposit. If a booking is made within 10 weeks of the departure date then the full amount is payable at the time of booking.
1.3 Any cancellation of a photographic holiday made by the client must be made in writing and will incur a cancellation charge equal to the deposit paid at the time of booking when made more than 10 weeks prior to the event date. Cancellations made within 10 weeks of the event date will incur a cancellation fee equal to 100% of the holiday fee.
1.4 The receipt of a deposit does not imply acceptance of a booking. We will confirm our acceptance of your booking in writing, and it is at the time we send out this confirmation that a contract comes into existence between us.
For photographic workshops:
1.5 Full payment of the course fee is payable on booking, unless otherwise agreed with CWPW Ltd.
1.6 Any cancellation of a photographic workshop made by the client must be made in writing and will incur a cancellation charge of £20.00 when made more than 4 weeks prior to the event date. Cancellations made within 4 weeks of the event date will incur a cancellation fee equal to 100% of the course fee.
2) Changes to courses and/or holidays
2.1 CWPW Ltd reserves the right to alter or cancel any holiday. Should an alteration or cancellation become necessary, you will then have the choice of accepting the change, taking an alternative holiday (and where this is of a lower price we will refund the difference), or withdrawing from the contract and accepting a refund of all monies paid to CWPW Ltd.
2.2 In the event of the specified tutor being unable to attend due to illness or other circumstances beyond our control, another tour leader will be provided.
2.3 Where airport/hotel transfers are included in the cost of the holiday, such transfers are only guaranteed when participants travel on the flights specified by us. We will always seek to accommodate participants arriving or departing on different flights, however, when this is impractical participants will be responsible for their own transfer costs and arrangements.
2.4 In the unlikely event that we become unable to provide a significant proportion of the services you have booked after you depart, we will make alternative arrangements for you at no extra charge.
2.5 If you have special dietary or other requests, you should inform us of these prior to departure. We will advise the relevant supplier of your requirements, but we cannot guarantee that such requests will be met, and will have no liability to you if such requests are not met.
2.6 The type of holidays we offer requires flexibility and must allow for alternatives. For this reason the outline itinerary and holiday description must be taken as an indication of what may take place on the holiday, and not as a contractual obligation on the part of the company.
3) Losses and liability
3.1 CWPW Ltd does not accept liability for any loss or additional expense caused by delay or interruption to travel services through weather conditions, civil disturbance, industrial action, strikes, wars, floods or sickness. Such losses or additional expenses are the responsibility of the participant.
3.2 CWPW Ltd does not accept responsibility or liability for death, bodily injury or illness caused to the client or any other person included on the booking form unless arising from the negligent act of the Company’s employees (whilst acting in the course of their employment). Any claims shall be subject to English law in respect of any question of liability or quantum, and all proceedings shall be within the exclusive domain of the English courts.
3.3 The client must communicate any perceived failure in the performance of this contract on the spot to the tour leader thus giving the tour leader the opportunity to achieve a satisfactory solution. Should this not be possible, you should make your complaint known to us in writing within 28 days of the completion of the holiday.
4) Insurance
4.1 CWPW Ltd provides no travel insurance cover. We therefore strongly advise obtaining the appropriate travel insurance cover before you set out on the holiday or workshop (whether abroad or in this country).
5) Travel documents
5.1 For overseas travel, all clients must be in possession of a valid passport and all visas, permits and certificates, including medical certificates required for the whole of the journey and the client accepts responsibility for obtaining the same. All information and advice given by us on visas, vaccinations, climate, clothing, baggage, special equipment, etc. is given in good faith.
Declaration
By paying the full course fee in respect of a photographic workshop or by signing the booking form (in respect of a photographic holiday), you are agreeing to accept all the above conditions. The person who makes the payment and/or signs the booking form does so on behalf of all the individuals included in the booking, so that all are bound by the booking conditions.
Terms and conditions for image use
For the purpose of these Terms and Conditions Chris Weston (Wildlife Photography) Limited shall be referred to as CWWP. The visitor to the site or the individual (whether representing an organization or not) who contracts to purchase the rights to an image shall be referred to as the Client.
In this agreement the term image(s) or image includes transparency, negative and digital image files or any other item which may be offered for the purpose of reproduction; the term reproduction includes any form of publication or copying of the whole or part of any image(s) whether altered or not and whether by printing, photography, slide projection (whether to an audience or not), xerography, electronic or mechanical reproduction or storage, or for any use as artist's reference or illustration, or in a layout or presentation.
